Ordinance amending Loveland Codified Ordinance Section 111.01 Mayor's Court Fees

              WHEREAS, the City of Loveland routinely reviews all ordinances; and


              WHEREAS, the fines established for the Loveland Mayor’s Court have not increased with inflation, and


              WHEREAS, the City desires to expand the number of offenses that can be paid out in lieu of court appearance.


              NOW, THEREFORE BE IT by the Council of the City of Loveland, Hamilton, Clermont and Warren County, Ohio: Section 111.01 Mayor’s Court Fines and Fees is amended to read as follows:




(a)   Payout schedule for traffic, general offense, business regulation and street, utility and public service violations.  The payout amounts listed are the amounts of money an individual would pay to the Clerk of Courts if an individual desires to payout a citation instead of appearing in court. The payout amounts set forth herein include a fine. All court costs, including any costs mandated by the State of Ohio and City of Loveland, are added to the following:

(b)   All other minor misdemeanor violations, and all unclassified misdemeanors which do not require a mandatory jail term under Ohio law, not listed above or minor misdemeanor violations with other fine amounts as described in the Loveland Municipal Code shall be subject to a payout of $200.00.


(c)   In addition to the payout schedule changes, a $50.00 warrant fee will be imposed if a warrant is issued by the City of Loveland's Mayor's Court for failure to appear in Mayor's Court or failure to pay fines levied by the Mayor's Court.


(d)   A prisoner confined pursuant to Codified Ordinance Section 525.18 (a) shall receive a credit for time served at the rate of $50.00 per day or fraction of a day, or such other rate as set forth in the Ohio Revised Code.  


              Section 2.               Council hereby finds and determines that all formal actions relative to the passage of this legislation were taken in an open meeting of this Council, and that all deliberations of this Council and of its committees, if any, which resulted in formal action, were taken in meetings open to the public, in full compliance with applicable legal requirements, including Section 121.22 of the Ohio Revised Code.


              Section 3.               That this ordinance shall take effect from and after the earliest time allowed by law.
